
High Court Deals Cleophas Malala Blow On 6-Month Long Case
The High Court upheld Cleophas Malala’s removal as Secretary General of the United Democratic Alliance (UDA).
Justice Bahat Mwamuye issued the order on Monday, April 28, overturning a decision made by the Political Parties Disputes Tribunal (PPDT) that had temporarily reinstated Malala to his post in UDA.
In its decision, the court reiterated that the gazette notification that codified Malala’s expulsion was enforceable and legal.
“The 1st respondent’s appeal before the PPDT is hereby terminated and shall not proceed before the tribunal. Any orders previously issued in favour of the respondent are hereby vacated,” the ruling stated.
Proceedings before the PPDT were also essentially invalidated, which means Malala will no longer be able to contest his expulsion through that path, dealing another devastating blow to the former Secretary-General.

The court verdict also confirmed Hassan Omar’s nomination as the official UDA Secretary-General, effectively solidifying the ruling party’s recent leadership changes.

In October of last year, the now-former Secretary General attempted to challenge his dismissal by bringing the matter before a tribunal.
The panel ordered the Registrar of Political Parties, Anne Nderitu, to refrain from making changes to the UDA hierarchy while Malala’s case was pending.
Malala’s expulsion came after weeks of disagreements with the party, prompting the UDA’s National Executive Council (NEC) to call an emergency meeting to discuss the next steps, which, of course, included removing Malala from his position.
After the meeting presided over by the party’s national chairperson, Cecile Mbarire, Malala’s appointment as the interim secretary general of UDA was revoked in August 2024 and the changes were later made official in a gazette notice.
